THE HONOLIRABLE SMT. JUSTICE T. MADHAVI DEVI CRIMINAL PETITION NO.9434 OF 2023 AND CRIMTNAL PETITION NO.9436 OF 2023 ;

COMMON ORDER These two Criminal Petitions are filed against the orders of the X Additional Metropolitan Magistrate at Medchal-Malkajgiri District (for short, 'the trial Court') ln Crl.M.P.Nos.750 and 751 of 2021 in C.C.No.246 of 2017 dt.02.09.2023. The application in Crl.M.P.No.750 of 2023 was for return of the passport and to permit the petitioner to travel abroad, while the application in Crl.M.P.No.75 I of 2023 was to , permit his counsel to represent the petitioner herein. 2.

Both the leamed counsel advanced their respective arguments, however, this Court finds that the C.C. is originally of the year 2015, i.e., C.C.No.896 of 2015 and subsequently it was renumbered as C.C.No.246 of 2017.It is stated that both the petitioner and the accused are in India and the case is posted for cross-examination of the witnesses before the trial Court. Since the case is of the year 2015 and nearly 8 years have passed thereafter, this Court is of the opinion that in the

re \i<;r Crl.P.Nos.9434&9436 o12023 interest of justice, the trial should be concluded within a period of one month from the date of receipt of a copy of this order by conducting the trial expeditiously, ifnecessary on day-to-day basis. Both the parties are directed to participate and cooperate for early disposal of the case. If for any reason, the trial is not concluded within the above mentioned period, the petitioner herein shalt be at tiberty to file petitions challenging the impugned orders.

This Criminal Petition is accordingly disposed of. 4.

Pending miscellaneous petitions, if any, in this Criminal Petition shall stand closed.
