THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.23155 of 2012 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of mandamus to declare the inaction of the respondents 1 to 4 in not approving the Pi petitioner in grant-in-aid post of B.Ed Assistant and as well as grant in aid post of SGT of the 2nd petitioner in the 5th respondent school having been appointed by the 4th respondent on 19.12.2011 inspite of written representations made by the petitioners on 02.06.2012 and as well as 05.07.2012 is illegal, arbitrary and violation of Article 14 & 21 of Constitution of India and consequently direct the respondents 1 to 3 to pass orders on the representations dated 02.06.2012 and 05.07.2012 made by the petitioners for approval of the petitioners appointments made in grant-in-aid post of B.Ed., Assistant and Grant In Aid Post of SGT in the 5th respondent school."

Heard the learned counsel for the petitioner and learned Government Pleader for School Education for respondents. During the course of hearing, it is submitted by learned counsel for the petitioners that pending writ petition on 03-08-2012 the 4th respondent addressed a letter to the official respondents herein requesting for approval of appointments and no action has been taken pursuant to the said letter so far. A request is made by the learned counsel for the petitioner to direct the official respondents to pass appropriate orders pursuant to the letter, dated 03-08-2012, in accordance with law, by fixing some timeframe. The said request is not opposed by the other side.

Recording the said submission and having regard to the nature of controversy, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the official respondents to take appropriate action on the letter, dated 03-08-2012 said to have been addressed by the 4th respondent to the official respondents, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
