THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7546 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.731 of 2022 on the file of Uppal Police Station, Rachakonda Commissionerate, registered for the offences punishable under Sections 366, 376 (2) (i) of Indian Penal Code and Section 3 read with 4 of POCSO Act, 2012.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against the petitioner is that he was in love with the victim girl and accordingly took the victim girl to Badargov Village, Bidar of Karnataka State and stayed with her from 18.07.2022 to 22.07.2022.

Learned Counsel for the petitioner submits that a false case is filed without there being any rape as alleged. He filed affidavit of the father of the victim girl stating that he has no
grievance against the petitioner.
Learned Counsel also produced the defacto complainant and his daughter-victim girl, who were questioned by the learned Assistant Public Prosecutor.

The parents of the victim girl and also the victim girl unanimously stated that there is no offence of rape which was committed.

However, learned Assistant Public Prosecutor submits that injuries are found on medical examination. 7.
Keeping in view the detention of the petitioner from 22.07.2022, the petitioner can be granted the relief of bail subject to the following conditions:
i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of VI Additional Metropolitan Magistrate at Hastinapuram, L.B.Nagar.
ii) The petitioner/Accused, after release shall appear before the concerned Station House Officer every Monday and Thursday between 10.30 A.M. to 1.00 P.M., for a period of eight weeks, for the purpose of investigation.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 8.
Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
