HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37362 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioners seeking the following relief: " to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents in conducting the enquiry, issuing the pattedar pass books and title deeds for the agricultural lands in Sy No. 358 extent 2.46 cents, in Sy No. 364 extent 3.86 cents, in Sy No. 357-1 extent 4.88 cents and in Sy No. 365 extent 7.42 cents situated at Agraharam village, Piler Mandal, Chittoor District in favour of the petitioners in pursuance of the applications dated 11.8.2016 and 29.7.2013 as arbitrary and illegal and violative of provisions under A.P.

Record of Rights in Land and Pattedar Pass books Act 1971 and also violation Article 14, 21 and 300A of the Constitution of India and consequently direct the Respondents to issue the pattadar pass books and title deeds and also mutate the names of the petitioners in the revenue records or to pass such any other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." Heard the learned counsel for the petitioners as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

Though various grounds are raised in the writ petition, the learned counsel for the petitioners restricts his prayer seeking a direction to the respondents to consider the representation dated 11.08.2016 made by the petitioners for issuance of pattadar pass books and title deeds.

Learned AGP would submit that the 3rd respondent may be directed to dispose of the representation of the petitioners, if the same is still pending consideration.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 3rd respondent-Tahasildar to consider the application dated 11.08.2016 made by the petitioners seeking issuance of pattadar pass books and title deeds in respect of agricultural lands in Sy.No.358 admeasuring Acs.2.46 cents, in Sy.No.364 admeasuring Acs.3.86 cents, in Sy.No.357-1 admeasuring Acs.4.88 cents and in Sy.No.365 admeasuring Acs.7.42 cents situated at Agraharam village, Piler Mandal, Chittoor District, if the same is still pending consideration, and dispose of the same in accordance with law as early as possible preferably within a period of eight weeks from the date of receipt of a copy of this order.
