THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL MISCELLANEOUS APPEAL No.576 OF 2009 ORDER:

This civil miscellaneous appeal is filed under Order XLIII Rule 1 of CPC, assailing the order dated 26.3.2009 passed in I.A. No.4374 of 2008 in O.S.No.738 of 2008 on the file of the Court of Chief Judge, City Civil Courts, Hyderabad.

The learned counsel for the appellant submitted that the appeal has become infructuous. Even as per the Office note, the trial Court disposed of the suit on 22.6.2010. In view of the disposal of the suit, the very purpose of filing of the appeal has become infructuous.

Hence, the civil miscellaneous appeal is dismissed as infructuous. Miscellaneous petitions if any pending in this appeal shall stand closed.
