THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.16568 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. This Writ Petition was filed seeking a direction to consider the applications of the petitioner dated 08.08.2013 and 02.06.2015 for appointment as a fair price shop dealer pursuant to G.O.Ms.No.4, dated 28.02.2014. Though this matter came up for consideration on 11.06.2015, no instructions have been received by the learned Government Pleader and therefore the case is posted to today.

3. The case of the petitioner is that his father was appointed as a fair price shop dealer of Bandameedakammapalle, H/o. Nerabailu Village, Yerravaripalem Mandal, Chittoor District. He died on 13.07.2013. Thereafter, the seventh respondent issued orders appointing one in-charge dealer, who is the dealer of shop No.17 of Udayamarikyam Village. In those circumstances, the present Writ Petition was filed.

4. In view of the undisputed fact that the petitioner is the son of deceased dealer, his applications should have been considered in accordance with G.O.Ms.No.4, 28.02.2014. In the circumstances, the seventh respondent is directed to consider and dispose of the applications of the petitioner dated 08.08.2013 and 02.06.2015 within a period of 30 days from the date of receipt of a copy of this order.

5. The Writ Petition is, accordingly, disposed of. No order as

to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
