THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.1541 of 2014 ORDER:

This revision petition is filed by the petitioner under Article 227 of the Constitution of India questioning the orders dated 09.04.2014 in I.A.No.179 of 2014 in O.S.No.262 of 2002 on the file of the Court of Additional Senior Civil Judge, Chittoor. At the time of hearing, learned counsel for the petitioners has sought permission of this Court to permit the petitioners to withdraw the revision petition with liberty to urge the points raised in this revision before the trial Court. Both counsels with one voice submitted that the trial Court may be directed to dispose of the suit. Learned counsel for the petitioners submitted that the trial Court may be directed to appreciate the evidence of D.W.2 in the light of the provisions of the Indian Evidence Act. Permission as sought for is granted.

Accordingly, the Civil Revision Petition is dismissed as withdrawn. The trial Court is directed to dispose of O.S.No.262 of 2002 itself within a period of three months from the date of receipt of copy of this order. Consequently, Miscellaneous Petitions, if any, pending in this Revision Petition shall stand closed.
