HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 21007 of 2012 Order:
This writ petition was filed challenging the action of the respondents in not considering the petitioner's representation, dated 06.07.2012, for renewal of existing TFT licence, which was valid up to 30.09.2012, for further block period of five (5) years from 01.10.2012 to 30.09.2017 in respect of Toddy shop, situated at Komsetpalli village, Marpally Mandal, Ranga Reddy District.
2. A counter affidavit is filed stating that the petitioner is in the habit of making applications for renewal of licence and, even though he was involved in adulteration on 30.03.2002, in view of the renewal of licence he has been successfully avoiding departmental proceedings for the last ten years. The counter affidavit further states as follows. "It is submitted that in view of the Court directions, the departmental proceedings could not be taken up. It is submitted that the respondents are ready to consider the representation of the petitioner for renewal of his licence but however seeking liberty of this Hon'ble Court to proceed against the petitioner departmentally."
3. In view of the above statement, this Writ Petition is disposed of directing the respondents to consider the representation of the petitioner for renewal of his licence, if it is not already considered. However, liberty is also given to the respondents to proceed against the petitioner departmentally, if any irregularity was committed by him. There shall be no order as to costs.
4. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
