THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 17844 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner was appointed as a Fair Price Shop Dealer of Shop No.1301 of Narsingapoor Village, Veenavanka Mandal, Karimnagar District. The Deputy Tahsildar, Civil Supplies, Peddapalli, inspected the shop on 13.01.2015 and noticed some variation in the stock and accordingly conducted a panchnama and seized the stock. He submitted a report to the 3rd respondent. On the basis of which, the 3rd respondent issued a show cause notice on 14.01.2015. The learned counsel for the petitioner submits that the said show cause notice was received on 05.02.2015 and as indicated therein the petitioner submitted his explanation within seven thereof on 10.02.2015. But without considering the explanation of the petitioner, the impugned order was passed on 02.02.2015 keeping the authorization of the petitioner under suspension. Challenging the said order, the present writ petition is filed.

A perusal of the order shows that the petitioner did not submit any reply within the stipulated time, as a result of which, the impugned order was passed by the 3rd respondent on 02.02.2015 pursuant to the show cause notice issued on 14.01.2015. Though the learned counsel for the petitioner is disputing the date of receipt of the show cause notice and submitting that the reply was submitted within the prescribed time after the receipt of the show cause notice; but in view of the allegations, he does not press the same. However, since the petitioner had already submitted his explanation on 10.02.2015, this Court feels it appropriate to direct the 3rd respondent to complete the enquiry initiated against the petitioner independently without depending on 6-A proceedings within a period of 30 days from the date of receipt of a copy of the order and pass final orders after giving due opportunity to the petitioner.

4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 19th June, 2015 Note: Furnish C.C. in three days.
