The petitioner prays for the following relief: " ...writ of Mandamus under article 226 of the Constitution of India declaring the action of the respondents in taking steps to award the work "BT road from Dagadarthi to BD road via Turimerla in Dagadarthi Mandal of SPSR Nellore District" pursuant to the eprocurement tender notice No.T0/27/2016-17 dated 27.06.2016 of SE, PR, Nellore, SPSR Nellore District, to the 4th respondent even though 4th respondent is not having qualification criteria for opening of the price bid as per condition No.3.3 (b) without consideration the representation of the petitioner dated 10.10.2016 as illegal and arbitrary..."
Mr. Subodh counsel for petitioner submits that respondents 2 and 3 are under obligation to take note of the objections pointed out in representation dated 10.10.2016 before awarding the subject contract to 4th respondent, and if a direction goes to respondents 2 and 3 to consider representation dated 10.10.2016, the petitioner is satisfied for the present.
The learned Government Pleader (Panchayat Raj) submits that the representation dated 10.10.2016 of petitioner will be considered in a time bound more particularly, without taking a decision whether to award or not in favour of 4th respondent. The writ petition is disposed of accordingly. No order as to costs.
