THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION Nos.2212 and 2135 of 2017 COMMON ORDER:
These Criminal petitions are filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") to quash the proceedings in C.C. No.1289 of 2016 on the file of the I Additional Chief Metropolitan Magistrate, Visakhapatnam, which is outcome of Crime No.62 of 2016 of Women Police Station, Visakhapatnam City, registered for the offences punishable under Sections 498-A, 506 and 509 Indian Penal Code (for short "I.P.C.") and Sections 3 and 4 of Dowry Prohibition Act, 1961.
Sri Nageswara Rao Pujari, learned counsel for the petitioners after arguing the matter for sometime, requested this Court to direct the police to follow guidelines formulated by the Apex Court in "Rajesh Sharma v. State of U.P.1"
Acceding to the request of the learned counsel for the petitioners, without touching the merits, I find that it is a fit case to issue direction to the police to follow the guidelines issued by the Apex Court in "Rajesh Sharma v. State of U.P." (referred supra). Accordingly, police concerned are directed to adhere to the guidelines issued in "Rajesh Sharma v. State of U.P." (referred supra). With the above direction, the Criminal Petitions are disposed of. Consequently, miscellaneous petitions pending, if any, shall also stand closed.
