THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.5011 OF 2010 ORDER:

This petition is filed for a writ of Mandamus declaring the auction notice dated 20.02.2010, issued by the 3rd respondent in respect of the land admeasuring Ac.3.08 cents, situated in Survey No.127 and 124 of Pallipadu Village, Indukurpet Mandal, SPSR Nellore District, which is under the possession of the petitioners, as illegal and arbitrary.

This Court on 04.03.2010 while admitting the writ petition granted interim order permitting the respondents to proceed with the auction. Today, when the writ petition is taken up for hearing, learned counsel for the petitioner states that he has given up 'vakalat'. There is no appearance on behalf of petitioners. Sri A.Srikanth Reddy, learned counsel for 3rd respondent submits that the impugned auction notice is issued for grant of lease hold rights of the subject land for a period of three years and by afflux of time three years period is already over and that now the petitioners are not in possession of the subject land. In view of the above, the cause in the writ petition does not survive of adjudication and accordingly the writ petition is dismissed as infructuous. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending, in the writ petition, shall stand closed.
