THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.21996 of 2016 ORDER:

This writ petition is filed under Article 226 of Constitution of India seeking a writ of mandamus declaring the action of the respondent Nos.2 to 6 in interfering with petitioners' possession and enjoyment of Anandapuram Ummadichervu in an extent of Acs.46.33 cents in survey Nos.1, 2, 34/1, 34/2, 35/1 and 41/9 of Anandapuram village, H/o.Muduthallapadu Gram Panchayat, Mandavalli Mandal, Krishna District as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents not to interfere with petitioners'

possession and enjoyment of Anandapuram Ummadichervu.

2. The petitioners filed W.P. No.37558 of 2014 seeking the same relief against the Revenue officials. In the said writ petition, this court passed the following order:

"Learned Assistant Government Pleader for Revenue (Andhra Pradesh) submits that the respondents are not interfering in any manner with the possession of the petitioners.

In that view of the matter, no further orders are needed to be passed in this writ petition and accordingly, it is disposed of. No costs.

Consequently, the miscellaneous applications, if any shall also stand disposed of."

3. The present writ petition is filed by the petitioners seeking the self-same relief against the Revenue officials as well as the officials of Fisheries department.

4. The learned Assistant Government Pleader for Fisheries (Andhra Pradesh) submitted that the respondent Nos.4 and 5 are not in any manner interfering with the peaceful possession and enjoyment of Anandapuram Ummadichervu by the petitioners. He further submitted that the land in question belongs to Forest department.

5. Taking into consideration the facts and circumstances of the case and also the orders of this court in W.P. No.37558 of 2014, no further orders needed to be passed in this writ petition.

6. With the above observation, this writ petition is disposed of. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
