HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.33982 OF 2017 O R D E R :

This writ petition is filed challenging the inaction of the respondents in considering the petitioners' representations dated 15.09.2017 and 19.09.2017, respectively, for payment of salaries, as illegal and arbitrary and for a consequential direction to the respondents to continue the services of the petitioners as Electrician and Driver, respectively. Learned Counsel for the petitioners submits that the 1st petitioner is working from 2002 as Electrician and the 2nd petitioner is working from 2012 as Driver in S.V.National Park, Tirupathi; that the petitioners are not being paid salaries for the last six months; and that the 1st petitioner has submitted representations dated 19.09.2017 to the 2nd respondent and the 2nd petitioner has submitted representation dated 15.09.2017 to the 3rd respondent in respect of their grievance. As no orders are passed on the same, present writ petition is filed.

Learned Government Pleader for Forests on written instructions submits that petitioners are out-sourcing employees; that they were never appointed by the Forest Department; and that since they were very irregular to the duties their services were discontinued from 30.06.2017 and 31.05.2017, respectively.

The contention of the learned Government Pleader that the petitioners are out-sourcing employees is seriously disputed by the learned counsel for the petitioners. It is to be seen that these aspects have to be considered by the 3rd and 4th respondents. In view of the same, without expressing any opinion on merits, the writ petition is disposed of directing the respondents 3 and 4 to dispose of the representations submitted by the petitioners, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order and take action accordingly. No order as to costs.

As a sequel to disposal of the writ petition, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
