THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4184 of 2005 ORDER:

This Writ Petition was filed assailing the action of the respondents in not regularizing the services of the petitioners as Junior Assistants in the service of Alluri Seetharama Raju Cooperative Junior College, Kalidindi, Krishna District. It appears that interim orders were passed directing the continuance of the petitioners in service but it is admitted that the said orders were not given effect to and in the meanwhile, the said College was taken over by the Government on 24.10.2011.

As the College in which the petitioners seek absorption of their services has now become a Government Junior College, they would necessarily have to approach the State Administrative Tribunal in the first instance as per the law laid down by the Supreme Court in L. Chandra Kumar vs. Union of India[1]. As the petitioners pursued this Writ Petition before this Court even after the takeover of the College by the Government in the year 2011 and are now being relegated to the Tribunal for seeking appropriate relief, this fact shall be taken into consideration by the Tribunal while dealing with the application, if any, filed by the petitioners seeking the relief claimed before this Court by way of this Writ Petition. The Writ Petition is accordingly disposed of leaving it open to the petitioners to seek redressal of their grievance before the State Administrative Tribunal in accordance with law. Pending Miscellaneous Petitions, if any, shall also stand

dismissed. No order as to costs.
