HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION NO. 9672 OF 2016 ORDER:

The grievance of the petitioner is that respondents 4 & 5 had dug the borewell, which is 60 meters away from his land. It is stated that the petitioner made a complaint to the third respondent against respondents 4 & 5. His grievance is that although the third respondent had issued proceedings dated 19.2.2016 for closing of the said borewell respondents 4 & 5 did not obey the said directions and the third respondent has not taken any action against them.

2. Learned Government Pleader for Revenue appearing for respondents 1 to 3 states that the third respondent could not have issued memo dated 19.2.2016 without hearing the respondents 4 & 5.

3. In view of the above submission, the Writ Petition is disposed of directing the third respondent to consider the petitioner's representation dated 13.2.2016 treating it as a complaint against respondents 4 & 5 under the provisions of Andhra Pradesh Water, Land and Trees Act, 2002, issue notice to respondents 4 & 5 and pass appropriate orders within six weeks from the date of receipt of a copy of the order. There shall be no order as to costs.
