THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.27297 of 2019 ORDER:

The present writ petition is filed to declare the action of the second respondent in interfering with the peaceful possession and enjoyment of the petitioners over the land to an extent of Ac.1.11 guntas in Survey No.190 of Kapugallu Village, Kodad Mandal, Suryapet District, as being illegal and arbitrary.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, based on the written instructions, dated 27.11.2019, a copy of which is placed on record of this Court, while denying the allegations made in the writ petition, submits that a case is registered against the first petitioner and others on the basis of the complaint made by the third respondent in this writ petition, in Crime No.146 of 2019 for the offences punishable under Sections 447, 324, 504 and 506 read with Section 34 IPC on the file of Kodad Rural Police Station, on 31.08.2019, and the first petitioner herein is arrayed as accused No.1 therein. It is also submitted by the learned AGP that except conducting investigation in the above case, the second respondent never interfered in the civil disputes of the petitioner, at any point of time.

Having regard to the submissions made on behalf of the official respondents to the effect that the second respondent never interfered in the civil disputes of the petitioners, this Court is of the view that no further orders need be passed in this writ petition.
