THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9449 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.627 of 2023 on the file of Jeedimetla Police Station, Cyberabad, registered for the offence under Section 20 (b) (ii) (B) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act'). 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

On 16.08.2023, the Detective Inspector of Police apprehended this petitioner in Vigneshwara Guest House and found in possession of Hashish (Hash) oil in 29 small bottles. The total Hashish (Hash) oil was of 145 ml. 4.

Learned counsel for the petitioner would submit that procedure prescribed for sampling was not followed

by the Police. However, the quantity seized is intermediary.

On the other hand, learned Additional Public Prosecutor on instructions would submit that there are no other cases pending against this petitioner. 6.

In the circumstances of the present case, the petitioner can be granted the relief of regular bail to the petitioner, subject to following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of VIII Additional Metropolitan Magistrate at Medchal, Cyberabad, Medchal District.

ii) The petitioner/Accused after release shall appear before the concerned Station House Officer at 10:00 a.m. everyday for a period of two weeks for the purpose of investigation and thereafter, as and when required.

iii) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
