THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE D.V.S.S.SOMAYAJULU WRIT PETITION NOs.23040 AND 23068 OF 2018 COMMON ORDER: {Per the Hon'ble Sri Justice Ramesh Ranganathan} Heard Sri P.Venugopal, learned Senior Counsel appearing on behalf of the petitioner and Sri V.V.S.N.Raju, learned counsel for the second respondent and, with their consent, both the Writ Petitions are disposed of at the stage of admission.

The jurisdiction of this Court was invoked by the petitioner herein seeking a mandamus to declare the order passed, in two separate interlocutory applications in O.A.No.308 of 2000, by the Debts Recovery Tribunal-I, Hyderabad as arbitrary and illegal.

It is brought to our notice that O.A.No.308 of 2000 has itself been subsequently disposed of by order dated 05.10.2018; and, consequently, the cause in these two Writ Petitions no longer survives.

Sri P.Venugopal, learned Senior Counsel, would seek liberty to question the order passed by the Debts Recovery Tribunal in O.A.No.308 of 2000 dated 05.10.2018 in appropriate legal proceedings. Granting liberty as sought for, and as the cause in both the Writ Petitions no longer survive, both the Writ Petitions are dismissed. There shall be no order

as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
