THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No. 26200 OF 2019 O R D E R :

This writ petition is filed to declare the action of the respondents 6 and 7-police, in calling the petitioner frequently to the police station and harassing the petitioner to settle the disputes with respondent No.8, as illegal and arbitrary.

Heard learned counsel for the petitioner, learned Assistant Government Pleader for Home appearing for respondents 1 to 7 and Sri K.Pavan Kumar, learned counsel for respondent No.8. Learned Assistant Government Pleader for Home produced written instructions dt.04.12.2019, stating that the petitioner has approached this Court without disclosing the correct facts and has made false statement that the respondent authorities are calling the petitioner under the pretext of investigation in FIR.No.27/2017, on the file of Saroornagar Police Station, Rachakonda Commissionerate. He further submits that while the investigation in the said case is pending, another complaint was lodged on 27.09.2019 against the petitioner, his wife and another, upon which a case in Crime No.649/2019 under Sections 406, 420, 384, 120 (b) read with 34 IPC was registered against them.

It is stated in the written instructions that the petitioner on coming to know about lodging of new case against him, in order to

prevent the authorities from investigating into the said new case, has approached this Court by making false allegations against the respondent police.

Learned Assistant Government Pleader further submits that presence of the petitioner was required in connection with the investigation in the new crime registered against the petitioner in Cr.No.649/2019 and that the said investigation is being carried in accordance with law.

Having regard to the aforesaid submission made on behalf of respondents 1 to 7 herein, no further orders are required to be passed in this writ petition.

Accordingly, the writ petition is closed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition stand closed.
