THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO. 8230 of 2017 ORDER :

The present criminal petition came to be filed under Section 482 of Cr.P.C. seeking to quash the proceedings in C.C.No.6 of 2016 on the file of Additional Judicial Second Class Magistrate, Tenali, Guntur District. A charge sheet came to be filed against the petitioner and others for the offences punishable under Sections 323, 324, 506 read with Section 34 of IPC.

Though various grounds are raised, learned counsel for the petitioner mainly submits that the petitioner is a heart patient and it would be difficult for him to come to the trial Court on every date of adjournment. Hence seeks dispensation of his presence, as there is no dispute with regard to his identity. The same is not disputed by the learned Additional Public Prosecutor.

Having regard to the above submissions made, the criminal petition is disposed of dispensing the presence of the petitioner who is A3 in C.C.No.6 of 2016 on the file of Additional Judicial Second Class Magistrate, Tenali, Guntur District, except on the dates when his presence is required by the Court.

Consequently, miscellaneous petitions, if any pending, shall stand closed.
