HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CIVIL REVISON PETITION No.601 of 2017 ORDER :
Both parties present and stated that outside the Court to confirm the ex parte decree of divorce, they want to dissolve the marital tie, thereby the revision is to be allowed.

Accordingly, the civil revision petition is allowed by setting aside the order of the lower Court condoning the delay in filing the petition to set aside the ex parte decree with a consequence that the ex parte decree before the lower Court stands and once the Section 5 of the Limitation Act by allowing the revision setting aside the order of the lower Court ends in dismissal the application to set aide the ex parte decree order deserves rejection, consequently rejection though the application is not before the Court by virtue of this order with a direction to the lower Court to close that petition. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
