HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.12477 of 2015 O R D E R :
The petitioner, who is accused No.2 in Crime No.324 of 2015 of Parakala Police Station, Warangal District, registered for the offences punishable under Section 420 I.P.C. and Sections 4 and 9 read with Section 76 of Chit Fund Act and Section 5 of APPDFE Act, filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail. The allegation against the accused is that they have collected chit amounts for 26 instalments at the rate of 12,500/- per month and failed to pay the money. Admittedly, Vijayasree Chits and Finance is not a registered one. The petitioner - accused No.2 is a partner of unregistered chit company.
It is informed by the learned Public Prosecutor that number of persons are now lodging complaints informing the failure on the part of the company concerned and another case is registered in crime No.379 of 2015.
Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to petitioner - accused No.2. Accordingly, the Criminal Petition is dismissed. ______________________ JUSTICE RAJA ELANGO 03rd December, 2015 skmr
