Pursuant to the notification dated 07.10.2015 for the post of Anganwadi Worker of Thodendlapalli Village, petitioner responded to the said notification. In the selections conducted on 24.11.2015, petitioner got 62 marks and stood in second position in the selections. The first meritorious candidate was appointed. However, noticing that she was not having the minimum age required, her services were terminated on 05.05.2016. Against the said termination, she filed W.P.No.16362 of 2016. This Court initially granted stay and thereafter stay was vacated. The said Writ Petition was dismissed by order dated 04.01.2017 granting liberty to the petitioner therein to avail appropriate remedy to establish her age. Thereafter, the third meritorious candidate filed W.P.No.38259 of 2017.
In the counter affidavit filed in the said Writ Petition, the 3rd respondent herein stated that the petitioner is the second meritorious candidate. By order dated, 14.03.2018, the said Writ Petition was dismissed as withdrawn. On 09.04.2018, petitioner submitted representation to provide employment as Anganwadi Worker as per her merit in the selections conducted on 24.11.2015. Alleging inaction, this Writ Petition is filed. 3.
Having regard to the facts noted above and since the issue is yet to be considered by the District Collector, without expressing any opinion on merits of the case, the Writ Petition is disposed of directing the District Collector, Kurnool District, to examine the
representation dated 09.04.2018 filed by the petitioner and to pass appropriate orders as warranted by law by assigning due reasons in support of the decision. The decision shall be taken and communicated to the petitioner within a period of six weeks from the date of receipt of a copy of the order. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
