THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.27565 OF 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue an appropriate writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the seizure of vehicle bearing No. AP 29 TB 3666 as per the Remand Case Diary dated 18-7-2015 in FIR No. 197 of 2015 is illegal, improper and without power or authority under law and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

When the matter is called, basing on the instructions dated 01.09.2015 furnished by Sub Inspector of Police, Keesara Police Station, Cyberabad Commissionerate, it is submitted by the learned Government Pleader that all the vehicles including subject vehicle of the petitioner were deposited before the Court of the X Metropolitan Magistrate, Cyberabad at Malkajgiri on 31.08.2015 vide CPR No.134 through Form 66.

3. On noticing the same, learned counsel for the petitioner has requested this court to keep it open for the petitioner herein to file necessary application before the learned Magistrate under Section 451 of the Code of Criminal Procedure for release of the vehicle.

4. In view of the above submissions, writ petition is disposed of, keeping it open for the petitioner herein to file necessary application before the learned Magistrate.
