HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.3471 of 2007 ORDER:

The Writ Petition is filed declaring the action of respondents, in acquiring petitioner's land admeasuring Ac.2.00 in Sy.No.172 situated at Gadivaripalem Village, Krosur Mandal, Guntur District, as being illegal and arbitrary.

This Court, by order in WPMP.No.4421 of 2007 dated 23.04.2007, granted an order of status quo.

In the counter affidavit filed by respondent No.2, it is stated that, subsequent to filing of writ petition, government land was identified for the beneficiaries and the beneficiaries were adjusted in the said land. It is further stated that the land of the petitioner is no longer required as the purpose was duly served, and action has been initiated for withdrawal of notification issued, under Section 4(1) of the Land Acquisition Act, 1894 (the Act), under Section 48(1) of the Act. In the facts and circumstances explained in the counter affidavit, no further orders need be passed in the writ petition. The Writ Petition is, accordingly, allowed.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
