HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 1369 OF 2005 AND WRIT PETITION No. 14939 OF 2005 JUDGMENT: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This writ appeal, filed in 2005, is directed against an interlocutory order dated 18-07-2005 passed in WPMP No. 18987 of 2005 in Writ Petition No.14939 of 2005. The interlocutory order reads thus:

"Heard. Till further orders, it is directed that in case document is presented by the petitioner for registration, it will be received and retained by the registering authority, but will not proceed to pass any order, thereupon during the pendency of the writ petition."

Having regard to the nature of interim order impugned in the appeal, in our opinion, nothing further survives in the writ appeal, more particularly in view of the fact that no interim order was passed at the time of admitting the appeal. That apart, learned counsel for the appellant - writ petitioner fairly submits that the question raised in the writ petition is squarely covered by the Full Bench judgment of this Court in Vinjamuri Rajagopala Chary and others vs. Principal Secretary, Revenue Department, Hyderabad & others (W.A.343 of 2015, 232 of 2012 and 352 of 2013) dated 23-12-2015 and, therefore, the writ petition itself may be disposed of with direction to the registering authority to consider the document presented for

registration in the light of the observations made and directions issued in the said Full Bench judgment.

In the circumstances, the writ appeal as well as the writ petition are disposed of as infructuous. The registering authority however shall consider the document presented for registration in the light of the judgment of the Full Bench.

Miscellaneous petitions, if any, also stand disposed of. No order as to costs.
