HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.7663 of 2019 ORDER :

Petitioner, who is accused in Cr.No.608 of 2019 on the file of the S.H.O. Medipally Police Station, Rachakonda District, registered for the offences punishable under Sections 366, 376 (2) (n) IPC and 3 and 4 of POCSO Act, 2012, filed this petition under Sections 437 and 439 Cr.P.C. seeking regular bail.

Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent State.

The learned Additional Public Prosecutor representing the State, on instructions, submits that both the victim and the accused belong to the State of Andhra Pradesh and the offence was committed in Andhra Pradesh. He further submits that the Inspector of Police, Medipally Police Station, investigated the said crime and collected the evidence. However, since the offence took place at Tirupathi, which falls under the jurisdiction of Tirupathi, East Police Station, the Inspector of Police, Medipally Polie Station, requested to transfer the case diary file to Tirupathi East Police Station on the point of jurisdiction for further investigation.

In view of the submission made by the learned Additional Public Prosecutor, this Criminal Petition has become infructuous due to lack of jurisdiction. 5.

Accordingly, the Criminal Petition is dismissed as infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
