HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CIVIL REVISION PETITION No.3314 of 2016 ORDER :
At the admission stage, the C.R.P. is disposed of with the following directions.
It is the grievance of the petitioners/defendants that in I.A.No.149 of 2014 in O.S.No.274 of 2014, the trial Court granted interim injunction in favour of the respondent/plaintiff and inspite of the petitioners/defendants filing their counter in I.A.No.149 of 2014 way-back on 17.10.2014 and showing their readiness for the inquiry in the subject matter, unfortunately, the trial Court did not take up the matter for inquiry and by virtue of the injunction, the petitioners are put to hardship.
Having regard to the above submission, this C.R.P. is disposed of with the direction to the trial Court to conduct inquiry in I.A.No.149 of 2014 in O.S.No.274 of 2014 expeditiously and after hearing both sides, pass an order on merits within two months from the date of receipt of a copy of this order. Both parties are directed to cooperate with the trial Court for the inquiry. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
