HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.22877 of 2018 ORDER:

This writ petition is filed seeking direction to the respondent-police to investigate the Cr.No.296 of 2017 of Saidabad Police Station, which was registered basing on the private complaint filed by the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that after registration of the crime, the same was investigated by the police and submitted proposals to the Assistant Commissioner of Police, Malakpet Division to refer the case as 'lack of evidence' and after getting permission, the police filed final report before the VII Additional Chief Metropolitan Magistrate at Hyderabad. Though there is no mention of issuing notice to the petitioner, learned Assistant Government Pleader on instructions submits that notice was issued to the petitioner. But the same was disputed by learned counsel for the petitioner. In view of the same, the writ petition is disposed of directing the competent authority to issue notice to the petitioner if not already issued. However, it is open for the petitioner to avail remedies available to him under law. No order as to costs.
