HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.7659 OF 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in C.C.No.861 of 2014 on the file of the II Additional Junior Civil Judge at Huzurabad. A charge sheet came to be filed against the petitioner/A-1 for the offence punishable under Section 498-A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act. Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioner/A-1 restricts his prayer seeking dispensation of the presence of the petitioner/A-1 before the trial Court on every date of adjournment on account of his medical condition that he is under treatment for Ataxia (not able to walk properly), Disortheria (not able to speak properly) and he is suffering with diffuse Cerebellar Atrophy (congenital) not likely to improve.

The learned Public Prosecutor submits that since the identity of petitioner/A-1 is not in dispute, his presence in the above C.C. may not be necessary on every date of adjournment. Having regard to the facts and circumstances of the case, the personal appearance of the petitioner/A-1 in C.C.No.861 of 2014 on the file of the II Additional Junior Civil Judge at Huzurabad, is hereby dispensed with except on the dates when his presence is specifically required by the Court.

With the above direction, the Criminal Petition is disposed of.

Miscellaneous applications, if any, pending shall stand closed.
