This writ petition is filed challenging the action of the official respondents in not taking any action on the FIR No.202/2017 registered basing on the complaint of the petitioner on the file of Buttaigudem Police Station. Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Home produced written instructions stating that basing on the complaint of the petitioner a case in Crime No.202/2017 was registered on 17.12.2017 for the offences punishable under Section 341, 323, 506, r/w 34 IPC of Buttaigudem Police Station; that during the course of investigation LWs.1 to 7 were examined and their statements were recorded; further, as per the evidence collected it was disclosed that no case is made out against the accused; that as such, the respondent No.4 has addressed a letter to the 3rd respondent on 30.05.2018 to refer the case as false; and that orders of the 3rd respondent are awaited.
In view of the aforesaid submission of the learned Assistant Government Pleader, the 3rd is directed to pass appropriate order on the letter submitted by the 4th respondent, and on such order, the 4th respondents is
directed to file final report before the concerned Court, within a period of four weeks from the date of receipt of a copy of this order after serving notice to the petitioner. However, it is open for the petitioner to avail alternate remedy as may be available to him under law. No order as to costs.
