THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26836 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.43 of Turkapalle Village, Gooty Mandal, Anantapur District. While so, the third respondent issued a show cause notice dated 30.03.2015, for which, the petitioner submitted his explanation on 10.04.2015. After receipt of explanation, the third respondent suspended the authorization of the petitioner, by his order 17.04.2015. Against the said order of suspension, the petitioner preferred an appeal to the second respondent, who disposed of the appeal, by his order dated 30.04.2015 directing the third respondent to dispose of the case within a period of six weeks from the date of receipt of that order. When the same was not done, the present writ petition is filed.

In view of the order passed by the second respondent dated 30.04.2015 and in view of the pendency of proceedings before the third respondent, this Court is not inclined to interfere with the enquiry process at this stage. However, the third respondent is directed to conduct an enquiry in respect of the allegations leveled against the petitioner and complete the same, within a period of 30 days from the date of receipt of a copy of this order, by giving due opportunity to the petitioner. 4.

The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
