HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.26195 OF 2019 ORDER (ORAL) :

This writ petition is filed by the petitioner questioning the inaction of respondent No.3 - Station House Officer, Santoshnagar Police Station, Hyderabad, in registering his complaint dated 18.11.2019 as being illegal and arbitrary, and for a consequential direction to the respondents to register a case based on his complaint.

2. Heard Sri Mohd. Moin Ahmed Quadri, learned counsel for the petitioner, and learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 3, and perused the material on record.

3. The learned Assistant Government Pleader for Home based on the written instructions dated 27.11.2019, a copy of which is placed on record, submits that upon receipt of the complaint from the petitioner on 18.11.2019, an entry was made in the General Diary and enquired into. He submits that during the course of enquiry, it was disclosed that a civil case was pending in the Court between the petitioner and the people named in the complaint, as such, respondent No.3 issued a notice to the petitioner, under registered post vide ENA439885184IN on 27.11.2019, informing him that his complaint is closed as the same is civil in nature.

4. In view of the above, if the petitioner is aggrieved by the aforesaid notice dated 27.11.2019 issued by respondent No.3, it is open for the petitioner to avail the remedies before the appropriate forum in accordance with law, as such, no orders need be passed in this writ petition.

5. With the above observations, the writ petition is closed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition stand closed.
