HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.11167 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.
2. This writ petition is filed seeking writ of Mandamus declaring the action of the 2nd respondent-Revenue Divisional Officer in suspending her authorisation as fair price shop dealer of the fair price shop No.23 of M.M.Halli Village, Kuderu Mandal, Anantapur District, by proceedings dated 02.04.2015 on flimsy grounds, without conducting any enquiry, as illegal and arbitrary.
3. Basing on certain allegations, which includes maintaining of register showing that the essential commodities were distributed to the bogus cardholders and also distributing the essential commodities with lesser quantity, the authorisation of the petitioner was suspended on 02.04.2015 by the 3rd respondent.
4. Considering the nature of the allegations made against the petitioner, this Court is of the view that a detailed enquiry has to be conducted on the allegations levelled against the petitioner. Hence, the 2nd respondent-Revenue Divisional Officer, Anantapur, is directed to conduct enquiry against the petitioner and pass final orders within a period of eight (8) weeks from the date of receipt of a copy of this order.
