THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.NO.8272 OF 2016

O R D E R

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the 1st respondent - State. The respondents 2 to 5 are the wife and minor children of the petitioner. They filed M.C.No.66 of 2016 on the file of Additional Metropolitan Sessions Judge for the Trial of Jubilee Hills Car Bomb Blast case cum Additional Family Court, Hyderabad, against the petitioner under Section 125 o f Cr.P.C., seeking maintenance and pending the main case, sought for interim maintenance.

The trial court by order dated 12.4.2016 in Crl.M.P.No.587 of 2016 in M.C.No.66 of 2016, considering the material evidence on record, held that the petitioner has sufficient means and has wilfully neglected and refused to provide minimum necessities to the respondents 2 to 5 herein, who are his legitimate wife and minor children and accordingly awarded an amount of Rs.4,000/- to the 2nd respondent and Rs.3,000/- to other respondents 3 to 5.

Having perused the impugned order passed by the trial court and the material on record, it cannot be said that the amount awarded towards interim maintenance is excessive or exorbitant and in my considered view, it is just and reasonable. I do not find any reason to interfere with the same and the criminal petition is devoid of any merit and the same is dismissed at the stage of admission. No costs.

Miscellaneous petitions pending if any, shall stand closed. ------------------------------ M.S.K.JAISWAL,J DATE:14.06.2016 AVS
