THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.MP No.176 of 2015 in Crl.P.No.16372 of 2014 & Crl.P.No.16372 of 2014 ORDER:

The de facto complainant and her counsel Smt.S.Vani are present. Accused Nos.1 to 3 and their counsel Sri E.Sambasiva Pratap are present.

Heard both sides and perused the petition.

On the report of the de facto complainant, the police of CCS (DD) Women P.S. registered FIR No.238 of 2011 against the accused for the offences under Sections 498-A and 406 IPC and under Sections 4 and 6 of Dowry Prohibition Act and investigating the matter.

Now, it is submitted by both parties that at the intervention of the elders, the parties have amicably settled their disputes according to which, the de facto complainant and her husband i.e., Accused No.1 have obtained divorce and they resolved the disputes concerning to present crime also and hence compromise may be recorded and criminal proceedings in FIR.No.238 of 2011 may be quashed in the interest of justice.

Having regard to the above submission and considering the fact that it is a matrimonial matter and the parties have amicably settled the disputes among themselves out of court and no useful purpose will be served even if the parties are driven to the trial as they compromised, and following the decision reported in Gian Singh v. State of Punjab and another[1] this criminal miscellaneous petition is allowed and compromise is recorded and consequently, proceedings in FIR No.238 of 2011 of CCS (DD) Women P.S are hereby quashed. In the result, both the Petitions are accordingly disposed of.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
