HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.40543 of 2016 ORDER:
Petitioners challenge communication Nos.FMC/Admn/201617/848, FMC/Admn/2016-17/850 and FMC/Admn/2016-17/849, dated 14.11.2016, by filing this writ under Article 226 of the Constitution of India.
After taking note of the objection on the maintainability of the writ petition, the petitioners seek leave of the Court to withdraw the writ petition with liberty to avail the remedy before the Court of competent jurisdiction.
Writ petition is dismissed as withdrawn by granting liberty as prayed for.
Keeping in view the urgency in the matter, learned counsel for petitioners requests that appropriate direction to the Court of competent jurisdiction may be issued to hear and dispose of the application filed and consider granting ex parte orders. This Court is of the view that the Court after entertaining the appeal, no doubt, will consider the prayers in accordance with law and pass orders.
