HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.23002 of 2018 ORDER:
Heard learned counsel for petitioners and the Assistant Government Pleader for Revenue.
The petitioners are aggrieved by either deletion of their names from revenue records and/ or making entries in favour of B.Mahender Reddy, A.Venkat Ramana etc., as illegal, arbitrary and unconstitutional.
The Assistant Government Pleader opposes the writ prayer by contending that the petitioners for either of the grievances would have filed appeal before the Revenue Divisional Officer, who would have examined the original record and passed orders. By filing the writ petition under Article 226, the relief is converted into maintenance of revenue records.
I have perused the writ prayer and noted the prayer in representations dated 30.09.2015, 04.04.2017 etc. Prima facie, this Court is in agreement with the objection raised by the Assistant Government Pleader. The petitioners place on record the change of entries, which according to them adversely affect their interest. In such case, this Court is of the view that the petitioners can be relegated to work out statutory remedies or remedy of appeal under Government orders before the Revenue Divisional Officer.
The writ petition is accordingly disposed of by granting liberty to work out one or the other prayers. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J Dt: 06-07-2018 Prv
