HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17241 OF 2010 ORDER:

This writ petition is filed challenging the order issued by respondent No.1 vide proceedings No.112/2963/93-FF(HC), dated 11-05-2010, wherein and whereby freedom fighters pension granted to petitioner was cancelled along with others.

Counter affidavit is filed on behalf of respondent No.1, wherein it is stated in para Nos 3 and 4 as under: "That the competent authority in the Ministry of Home Affairs has taken decision that the pension of such certifiers may be restored. However, since their integrity has been found to be doubtful, the certificate given by them will not be recognized while deciding any claim in future. That in view of the above pension of Shri Gurram Dasharath Ramulu cancelled through proceedings No.112/2963/93-FF (HC) dated 1105-2010 has been restored from the date it was suspended/cancelled, vide proceedings No.52/CC/93/2010-FF (HC) dated 30.11.2010.

Therefore, the cause of action in the writ petition does not survive and the writ petition is liable to be dismissed."

Heard learned counsel for the petitioner and Sri K.L.N.Raghavendra Reddy, learned Standing Counsel for

Central Government appearing on behalf of respondent No.1.

In view of the same, recording the contents of counter affidavit stated supra, this writ petition is disposed of. Pending miscellaneous applications if any shall stand closed.
