HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 8832 OF 2021 ORDER:

This Criminal Petition, under Section 438 Cr.P.C., is filed by the petitioner - Accused No.1 seeking bail in the event of his arrest in connection with non-bailable warrants issued in C.C.No.9773 of 2020 on the file of the XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad.

Learned counsel appearing for the petitioner submits that Crime No.662 of 2018 was registered on 26.11.2018 for the offence under Section 498-A of the Indian Penal Code. The petitioner left to Khatar on 20.11.2018 and charge sheet was filed in the year 2020 itself. In view of the pandemic and as there was no transport facility and the flights were banned, he could not come to India and as the petitioner has not appeared before the Court below, non-bail warrants were issued and look out circulars were also issued. He submits that the petitioner is ready to cooperate with the trial and till the trial is completed, he will not leave the country without the permission of the Court concerned and hence, his case may be considered for grant of pre-arrest bail. 3.

In these circumstances, this Court deems it appropriate to grant pre-arrest bail to the petitioner/A-1. 6.

Accordingly, this Criminal Petition is allowed and the petitioner/A-1 shall surrender before the XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, within one week from the date he reaches India and on such surrender, he shall be

released on bail on his executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the said Court.

Miscellaneous applications, if any, pending shall stand closed.
