THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2733 OF 2016 ORDER:
This Criminal Petition is filed by the accused No.1 to 3 under Section 482 Cr.P.C. seeking to quash the proceedings in PRC No.19 of 2015 pending on the file of Additional Judicial First Class Magistrate, Sanga Reddy at Medak District for the offences under Section 498-A IPC, Sections 3 & 4 of Dowry Prohibition Act and Section 3(1)(x) of Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act.
The grounds now raised by the learned counsel for the petitioners for quashing the impugned proceedings are all disputed questions of facts which can be adjudicated by the trial Court only after full-fledged trial. Hence, this Court is not inclined to interfere with the impugned proceedings. If the petitioners are of the view that the offence under Section 3(1)(x) of Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act is not made out as per the material placed by the prosecution, they are at liberty to file a discharge application and the trial Court is directed to consider and dispose of the same in accordance with law.
The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
