THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.23942 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking issuance of writ of mandamus to declare the action of respondent No.4 in not taking action on the petitioner's report, dated 06.07.2017, seeking to take proper and appropriate action against respondent Nos.5 to 7 for illegally entering into the land by high handedly beating and scolding in filthy language though there is an order of status quo, dated 13.06.2017, in W.P.No.19948 of 2017, as illegal and arbitrary and consequently, direct respondent No.4 to forthwith take action on the petitioner's report, dated 06.07.2017.

The case of the petitioner is that he has been in continuous possession of the land to an extent of Ac.3.60 cents and patta was granted in favour of his mother, who expired on 14.06.2017. On 06.07.2017, while the petitioner was carrying on agricultural operations along with others, respondent Nos.5 to 7 along with twenty persons highhandedly entered into his land and stopped the agricultural operations forcibly. They also beat the petitioner and others with sticks apart from scolding them in filthy language, even though the order of status quo was shown to them. Thereafter, the petitioner along with others went to Yellandu Police station and lodged a report on 06.07.2017 requesting the official respondent to take action against respondent Nos.5 to 7, but respondent No.4 refused to take the report. Hence, the report was

sent to Yellandu Police Station and to respondent No.2, through a courier, but till date, no First Information report was issued. Hence, he filed the present writ petition.

Learned Government Pleader for Home (Telangana), on instructions, submits that the petitioner claims to have sent the report, dated 06.07.2017, by courier and the same is not received in the police station.

Having regard to the above, learned counsel for the petitioner seeks permission of this Court to withdraw this writ petition with a liberty to send a fresh complaint by registered post with acknowledgment due or lodge a report in person. 5.

Permission, as sought for, is accorded.

Accordingly, the Writ Petition is dismissed as withdrawn giving liberty as prayed for. There shall be no order as to costs. 7.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
