THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.9680 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a writ, order or direction, more particularly a writ in the nature of Writ of MANDAMUS declaring the action of the 1st respondent i.e., Commissioner of Endowments, AP, Hyderabad in not re-fixing the seniority of the petitioner taking into consideration his date of joining the service and his promotion as a Superintendent, and pass such other order or orders as the Hon'ble Court may deem fit and proper."

2. Heard Sri M.Vidyasagar, learned counsel, appearing for the petitioner and learned Government Pleader for Endowments, appearing for the respondents.

3. During the course of hearing, it is brought to the notice of this Court that for redressal of the grievance of the petitioner, petitioner herein submitted a representation to the Commissioner of Endowments and no orders have been passed on the said representation till date.

4. Since the representation submitted by the petitioner herein for redressal of his grievance is still pending consideration before the Commissioner of Endowments - 1st respondent herein, this Court is of the considered opinion that the ends of justice would be met if the Commissioner of Endowments - 1st respondent herein is directed to pass appropriate orders on the said representation dated 15.12.2014 said to have been submitted by the petitioner herein by fixing some timeframe.

5. For the aforesaid reasons, Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 1st respondent - Commissioner of Endowments to pass appropriate orders on the representation dated 15.12.2014 said to have been submitted by the petitioner herein, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order in accordance with law.

6. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 23.03.2016 SS
