DEFENDANTS NOS.2 & 3 Petition under Section 148 read with Section 151 of the CPC praying that in the letter Dis.No.464/2022 dated 0810112022 addressed by the Vlll Additional District and Sessions Judge, Ranga Reddy District, L.B.Nagar, the High Court may be pleased to extend the time granted on 14-02-2022 in CRP No. 1929 oI 2021 for a further period of three months from to dispose of OS No. 132 of 2010 on the file of Additional Family Court, Ranga Reddy District at Hasthinapuram, FAC Vlll Additional District & Sessions Judge, Ranga Reddy District at L.B.Nagar. This petition coming on for hearing, upon perusing the petition and the letter Dis. No.464/2022 dated Bl7l22 addressed by the Judge, Additional Family Court, Ranga Reddy District, Hasthinapuram, FAC Vlll Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar.
The Court made the following Order :- The Registry has numbered this interlocutory application basing on the letter dated 08.07.2022 received from the learned VlllAdditional District & Sessions Judge (FTC), Ranga Reddy District at L.B.Nagar with a request to extend the time for a further period of three months for disposal of O.S.No.132 of 2010.
Perused the orders dated 14.02.2022 in CRP No.1929 of 2021 wherein and where under lhis Court while dismissing Civil Revision Petition confirmed the order impugned daled 22.1O.2021 in 1.A.No.444 of 2021 in O.S.No.132 of 2010 on the file of the Vlll Additional District & Sessions Judge (FTC), Ranga Reddy District at L.B.Nagar and directed learned Judicial Officer to expedite disposal of O.S.No.132 of 2010 and to make every endeavor to dispose of the same within three months from the date of receipt of copy of the order since evidence on behalf of the plaintiff was closed and on behalf of defendants DWs.1 and 2 were examined. However, learned Judicial Officer in her letter dated 08.07.2022 has submitted that she is holding full additional charge of that Court since 06.06.2022 and during her tenure DWs.
4 and 5 were examined, their evidence in cross-examination was recorded through Commissioner and the matter was posted to 27.06.2022 for further evidence of defendant and on that day, an application under Order 16, Rule 1 and 6 of CPC was filed by learned counsel for the defendants and that application was allowed, Advocate Commissioner was appointed to record evidence of witness of defendant No.1. By narrating all these facts leamed Judicial Officer has requested for three more months' time for disposal of the original suit. Having regard to the fact that the learned Judicial Officer is holding full additional charge of that Court and DWs.4 and 5 are also examined and the letter was only addressed on 08.07.2022, I am inclined to consider the request of the learned Judicial Officer. Accordingly, l.A.No.
1 of 2022 is disposed of by granting three months period from the date of letter dated 08.07.2022 to lhe learned Judicial Officer for disposal of O.S.No.132 ot 2010. Be it stated that no further extension of time will be given for disposal of the matter and the learned Judicial Officer shall report complrance immediately after disposal of the same.
