HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.581 of 2012 ORDER:

This Criminal Revision Case, under Sections 397 & 401 of the Code of Criminal Procedure, 1973 (for short, "Cr.P.C."), is directed against the order, dated 02.12.2011, in Crl.M.P.No.706 of 2011, on the file of the Sessions Judge, Nizamabad, whereunder and whereby the learned Sessions Judge dismissed the Crl.M.P.No.706 of 2011, which is filed to condone the delay of 226 days in filing the appeal against the acquittal judgment in C.C.No.552 of 2006, on the file of Judicial Magistrate of First Class, Special Mobile, Nizamabad.

2. This Court, by an order, dated 30.06.2016, directed the petitioner to take personal notice on respondents 1 to 3 by Registered Post with Acknowledgement Due mentioning the date of listing of the matter as 20.07.2016 and file proof of service before the Registry within two weeks from that day, failing which the Crl.R.C.No.581 of 2012 stands dismissed automatically and posted the matter on 20.07.2016. On 28.07.2016 also, at the request of the petitioner, the matter was adjourned to 04.08.2016.

3. Admittedly, this matter is pertaining to the year 2012 and even after an order is passed by this Court, the petitioner has not taken any steps for service of notice, which shows that the petitioner is not evincing any interest to prosecute the matter.

4. Having regard to the same, the Criminal Revision Case is dismissed. Miscellaneous petitions, if any, pending in this criminal appeal shall stand closed.
