THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION No. 26204 OF 2019 O R D E R :
This writ petition is filed declaring the action of 8th respondent in not disposing EOP.No.2 of 2019, as illegal, contrary to the provisions of the Telangana Panchayat Raj Act, 2018, and also contrary to the spirit of the Constitution of Election Tribunal and for a consequential direction to the 8th respondent to dispose of EOP.No.2 of 2019, forthwith, in accordance with law.
Heard learned counsel for the petitioner and Sri G.Narender Reddy, learned Standing Counsel for Gram Panchayat appearing for respondents 6 and 7.
Insofar as the disposal of election petition filed before the Election Tribunal is concerned, the State Government by Rule-7 of the Telangana Panchayat Raj (Authority to dispose petitions in respect of Gram Panchayats, Mandal Praja Parishads and Zilla Praja Parishads) Rules, 2018 framed under Telangana Panchayat Raj Act, 2018 specified that the election Tribunal shall enquire into the election petition as early as possible in accordance with the procedure applicable under the Code of Civil Procedure, 1908 for trial of the suits.
Having regard to the said provision, learned Presiding Officer of the Election Tribunal shall take note of the same while deciding EOP.No.2 of 2019.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition stand closed.
