THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 31389 OF 2017 O R D E R:
This writ petition is filed seeking a Mandamus to declare the action of respondent No.3-Sub-Inspector of Police, Venkatachala Satram Police Station, SPSR Nellore District in calling the petitioner to the Police Station in relation to the matrimonial disputes between her family and respondent No.4, as illegal and arbitrary.
Learned Government Pleader for Home (Andhra Pradesh) placed before this Court the written instructions received from respondent No.3, wherein it has been asserted that respondent No.4 lodged a complaint on 14.08.2017, which was made over to the Station House Officer. Since the dispute is in relation to late husband of respondent No.4 and the petitioner is none other than the mother-in-law of respondent No.4, counselling was conducted and they were advised to settle the family disputes before elders. There was no pressure on the petitioner, as alleged and there is no truth in the allegations.
In the light of the specific assertion of respondent No.3 and considering the nature of dispute between the petitioner and respondent No.4, interests of justice would be met if the directions are issued to the Police that the petitioner or any one connected with her, shall not be harassed in any manner. However, it is open to the Investigating Officer to conduct investigation and take
necessary steps with respect to the complaint said to have been lodged by respondent No.4.
With the above observations, the writ petition is closed. Consequently, the miscellaneous petitions, if any shall stand closed. No costs.
