THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.188 OF 2015 ORDER:

Heard learned counsel for the petitioners, learned Government Pleader for Revenue appearing for respondents 1 to 4 and learned Government Pleader for Home appearing for respondent No.5. In this Writ Petition the petitioners allege that the 2nd respondent is interfering with the possession of the subject land, which is a private property, without following due process of law and that the 4th respondent himself has issued proceedings dated 10.03.2006 acknowledging that the petitioners land is a private patta land.

Learned Government Pleader, on instructions, states that a survey of the subject land was done to identity the boundaries along with other neighbouring survey numbers at the instance of the Mandal Revenue Officer and that there is no interference with the petitioners' possession of land.

Having regard to the said submissions, the Writ Petition is allowed with a direction to the respondents not to interfere with the petitioners' possession over the subject land without following due process of law. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
