WRIT PETITION No.25848 of 2017 ORDER:
The limited grievance of the petitioner is that the petition filed by him under Section 3 and 9 of Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 (for short 'the Act') in the year 2016, praying for cancellation of pattadar passbooks and title deeds standing in the name of the respondents 6 and 7 therein, who were granted pattadar passbooks and title deeds in respect of the land in Sy.Nos.5/A1, 39/1, 46/2, 104/1, 118-A, 129/2, 130/1-1, 130/1-4, 38/1, 44/2C, 100, 130/2, 141/c, 64/2, 94/5 and 104/1 in an extent of Ac. 26-89 and Sy.Nos. 217, 221, 226, 129/1 and 133 for an extent of Acs.10-19, is pending before the District Collector, Nellore (3rd respondent). Alleging inaction of the 3rd respondent in not disposing of said petition filed by the petitioner under Section 3 and 9 of the Act, this writ petition is filed.
When the matter is taken up for consideration, on instructions, learned Assistant Government Pleader for Revenue submits that matter is posted on 19.08.2017, for hearing of both parties.
Recording the said submission, without entering into the merits of the grievance agitated in the writ petition, this writ petition is disposed of directing the 3rd respondent to pass appropriate orders in accordance with law, on the petition filed by the petitioner under Section 3 and 9 of Act, as expeditiously as possible, preferably within a period of eight (08) weeks from the date of receipt of copy of this order. He shall assign due reasons in support of his decision and communicate the decision to the parties. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Contempt Case shall stand dismissed.
